Big
Win for Our WSP
CVEO 3s!!!
The
Washington State Patrol (WSP) has decided to grant
the requested remedy of WPEA as follows:
Pursuant to the
Hours of Work article, the WSP will
designate all CVEO3 positions as overtime
eligible effective July 1, 2005. All
exchange time granted from July 1 to the
present will be converted to either overtime
or compensatory time upon mutual agreement
of the employee and the supervisor as
specified in the master agreement for
overtime eligible employees. WSP's payroll
section will work with supervisors and
employees to accomplish this conversion as
quickly as possible. An IOC will go out
from Captain Estes to the affected employees
notifying them of the change in their
determination.

WPEA filed two group grievances on
Overtime Exempt Status,
one at DNR and one at WSP
The DNR grievance has been submitted to
the pre-arb level. LRO and WPEA will be meeting on
September 26, 2005, to
determine if the matter can be resolved prior to
submitting it to arbitration. Again, WPEA is fully
prepared to take this matter to arbitration and we are
very confident that the state has violated the contract
and the FLSA by failing to appropriately determine if
employees qualify for an exemption or not. To qualify as
overtime exempt, the employee must meet certain criteria
or tests regarding their job duties AND be paid on a
salary basis at not less than $455 per week. Job titles
do not determining exempt status. In order to apply, the
employee’s specific job duties and salary must meet ALL
the requirements of the federal regulations.
The overtime exempt grievance at the WSP
is scheduled for hearing at the Step 3 level on
September 21, 2005.
